Maryland law does not permit an attorney to charge a fee without the approval of the Maryland Workers' Compensation Commission. Generally, the Commission will not approve a fee in excess of 20% of the permanent disability awarded and/or any settlement of your case. In addition, if your right to temporary total benefits is denied by the insurance company and a hearing is required, the Commission will generally approve a fee of 10% of the benefits awarded by the Commission that were due at the time of the Commission's Order.
An attorney may not charge a fee for office visits, research, telephone calls, etc. If you do not win your case your attorney may not charge a fee. If the insurance company pays all of your temporary total benefits voluntarily and you do not have any permanent disability or receive a settlement, your attorney may not charge a fee (absent special permission from the Commission which in theory could be granted but in practice is almost never requested).
