April 10, 2008 - Ken Berman Wins Four Million Dollar Verdict!

An Alexandria City Circuit Court returned a four million dollar verdict in favor of Ken's client, a victim of a horrific surgical fire. The jury found that the defendant surgeon, Deborah Hutchins, M.D., violated the standard of care by failing to take steps to prevent the surgical fire which ravaged Ken's client's face, neck and chest during a procedure which was scheduled as outpatient surgery. Due to the extensive scarring, Ken's client has endured multiple surgeries to correct the damage caused by the fire.

 

January, 2008 - Mike Feldman Wins Two Million Dollar Verdict!

A District of Columbia jury awarded Mike's clients two million plus for economic, pain and suffering, and loss of consortium damages! The defendant, Howard University Hospital, made no settlement offer prior to the verdict. Mike's client was injured by a psychiatric patient who was not properly restrained by the defendant. As a result, she was required to undergo multiple foot operations that resulted in a foot fusion. Mike had to overcome issues involving:

  • Whether a claim could be legally pursued due to his client's status as a contract worker provided by a temporary agency to Howard University Hospital;
  • Whether Howard University Hospital committed medical malpractice by removing the restraints from a psychiatric patient; and
  • The fact that the client's pre-exisiting degenerative arthritic conditions may have eventually caused the need for similar treatment

August, 2007 - Right Knee Injury Caused Injury to the Left Knee

Nadine Osinski, won another trial this past week for a Giant Food employee who injured her right knee in 2001 in a compensable workers' compensation claim. However, as a result of continued right knee problems, the employee's right knee gave way, causing her to fall and injure her left knee. The insurer contested the claim, but Ms. Osinski was successful in convincing both the Workers' Compensation Commission and a Circuit Court Judge that the employee's right knee was predisposed to giving way and that the resulting surgery to the left knee was causally related to the original 2001 claim.

December, 2006 - Nadine Convinces a Jury That Plantar Fascitis is Compensable

Nadine Osinski, in a two day jury trial obtained a ruling by the jury that a Montgmomery County Parks and Planning Commission employee's plantar fascitis was caused by his job. The jury reversed a prior Workers' Compensation Commission finding that it was not. Plantar fascitis is a foot condition that is often caused by frequent walking on hard surfaces and frequently requires surgery. Nadine was able to overcome the legal presumption that the Commission was correct in its ruling and effectively cross examine the County's medical expert. The jury only took thirty minutes to render its verdict.
