What Will We Do To Assist You With Your Medical Malpractice Claim?

All interviews are conducted by an attorney who will listen you.   After discussing the facts of your claim, and initial determination is made as to whether or not the case should be pursued.   Some of the factors we will consider are:

  • The likelihood medical malpractice occurred
  • Whether or not the injuries you have are related to the malpractice as opposed to you underlying medical condition
  • The extent of the injury
  • The difficulty of proving the claim
  • The jurisdiction where the claim must be filed
  • How close we are to the statute of limitations
  • Whether or not we have any conflicts in the case that would preclude us from representing you

If we decide to proceed then your medical records would be obtained and we would have your case reviewed by a medical expert.   If the opinion is positive, then we would discuss how to proceed.   Since generally, almost all medical malpractice cases involve litigation, we would attempt to identify our expert witnesses and all the potential defendants prior to litigation.  

Once litigation begins, there is likely to be an extremely complex discovery process in which many depositions are taken, motions are filed and disputes occur.   Claims of medical malpractice are not taken lightly by physicians, since even a small settlement causes them to be listed in a national registry.   Therefore, we must approach every case that is pursued as if it is going to trial!
