- Separation Agreements: Separation agreements are comprehensive agreements between spouses in which the couple can resolve the many difficult issues that accompany the break up of the relationship. These agreements can deal with issues of custody, visitation or access and division of marital property, to name just a few. A well-crafted separation agreement protects not only the rights of the divorcing parties but the also the rights of their children. Most importantly, a separation agreement can ensure that these important decisions are made by the parties themselves, not by a judge.
- Prenuptial and Postnuptial Agreements: These are planning documents written prior to, or after the marriage, which allow the parties to a marriage to resolve many of the issues that may arise should the marriage subsequently result in a divorce. The advantage of such documents is that they are negotiated in an atmosphere that is nor posioned by the emotions that often arise when a couple is plitting apart. They may be appropriate regardless of the amount of pre-marital assets
- Divorce: Maryland recognized two types of Divorce: Limited Divorce (Legal Separation) and Absolute Divorce. We urge clients to resolve issues related to divorce through a separation agreement or by attempting to negotiate issues out of court with assistance of counsel. This allows them to control the process, rather than having a determination imposed by the court.
- Property Division: If a marriage is dissolved, the assets obtained during the marriage need to be valued and divided in a manner that is fair and considers the needs of the parties and the children.
- Alimony: Alimony calculations rest on many factors, such as the length of the marriage, the income and assets of both parities, and the ability of the spouses to support themselves.
- Domestic Violence: Sometimes the parties’ disputes and arguments become violent and result in the filing of ex parte orders and criminal charges against one another.
